On 23 September 2025 the Italian Parliament definitively approved Law No. 132 which contains a comprehensive legal framework on artificial intelligence, in line with the principles of the AI Act (EU Reg. 2024/1689).
In particular, Law No. 132 regulates the following sectors which would be highly impacted by AI:
• Data protection, media, press and communication to the public in general;
• National security and cybersecurity;
• National Health System and scientific research;
• Employment relationships, including liberal professions;
• Justice and rules of law.
Law No. 132 also provides for the establishment of a national authority on AI and delegates the government to procure funds and investments for the development of national champions of AI incorporated and/or active in Italy.
All judicial disputes concerning AI shall be attributed to the exclusive competence of the specialised business courts.
Italian judicial system shall be authorized to exploit AI provided that the interpretation of the law, the application of legal rules and regulations as well as any judicial decision shall be exclusively reserved to judges.
With particular reference to the use of AI in the legal profession, Law No. 132 states that lawyers are entitled to avail themselves of AI systems as a support and instrument of their activities, provided that any information relating to the use of AI in the exercise of the profession is communicated to the client in a clear, simple and comprehensive way in order to preserve the fiduciary relationship.
Law No. 132 further introduces new criminal sanctions applicable to conduct perpetrated through AI, such as market and/or stock manipulation and agiotage. Moreover, Law No. 132 provides a new crime to punish anyone who publishes or distributes false images, videos or the voice of a person without his/her consent through AI systems in order to mislead others and cause harm to the affected person.
